Use the platform = agree to these terms. If you’re signing on behalf of a company, you’re saying you have authority to bind it.
By accessing or using Berry (the “Service”), you agree to be bound by these Terms. If you do not agree, do not use the Service. If you’re using Berry on behalf of an organization, you represent that you have authority to bind that organization.
What Berry actually is.
Berry is an AI-powered go-to-market platform: a swarm of autonomous agents that generate playbooks, discover and qualify leads, draft and send outbound messaging, and track pipeline. We provide the platform; you direct it.
Agent behavior is non-deterministic. Two runs of the same prompt may produce different outputs. We do our best to make the agents reliable; we don’t guarantee specific business outcomes (revenue, meetings booked, deals closed).
You’re responsible for what your seat does.
- Provide accurate information when you create an account.
- Keep your credentials secret — we will never ask you for your password.
- Notify us immediately if you suspect unauthorized access (security@getberry.ai).
- Don’t share seats — one human per seat is the deal. We watch for it.
Things you cannot aim Berry at.
Berry is built to help legitimate B2B teams reach buyers who would plausibly want to hear from them. You agree not to use the Service to:
- Send spam, harass individuals, or contact recipients in jurisdictions where outreach to them is unlawful.
- Impersonate another person, brand, or institution.
- Promote firearms, narcotics, illegal financial services, or content prohibited under KSA, UAE, EU, or US law.
- Train competing AI/ML systems on the platform, our agent outputs, or our APIs.
- Reverse-engineer, scrape, or attempt to extract the underlying agent prompts or model weights.
All outreach sent through the platform must comply with CAN-SPAM, GDPR, the UAE Federal Decree-Law No. 14/2023, the KSA Anti-Cyber Crime Law, and any other regulation applicable to the recipient. You are the controller; we are the processor.
Agents draft. Humans approve.
Whatever Berry writes, you own — and you’re responsible for sending it. We give you the rails and the brakes.
You can configure Berry to run with full human-in-the-loop approval, partial approval (only outreach above a confidence threshold), or full autopilot. The default is human-in-the-loop. Whichever mode you select, you are responsible for what gets sent under your domain.
Agent-generated lead research can be wrong. Always verify before high-stakes outreach. Don’t rely on Berry as the sole source of truth for legal, regulatory, or financial decisions.
Your content stays yours.
Content generated by AI agents on your behalf — playbooks, emails, lead research — is yours to use, copy, and modify. You grant us a limited license to host and process it for the purpose of operating the Service.
The Berry platform, brand, agent prompt designs, and underlying model orchestration remain our property. You may not white-label, resell, or republish the Service without a written commercial agreement.
Billing, plain.
- Fees are billed monthly or annually in advance, in USD or AED at your election.
- Usage above your plan’s included quota is billed at the per-unit rate published in your order form.
- You can downgrade at any time; the downgrade applies on your next billing cycle.
- Fees are non-refundable except where required by law or our 30-day satisfaction guarantee.
The fine print — but readable.
The Service is provided “as is.” We don’t warrant that it will be uninterrupted, error-free, or that agent outputs will be accurate.
To the maximum extent permitted by law, our total liability to you for any claim arising out of these Terms or the Service is capped at the greater of (a) $5,000 USD, or (b) the fees you paid us in the 12 months before the claim arose.
We are not liable for indirect, incidental, consequential, or punitive damages — lost profits, lost data, lost goodwill — even if we’ve been told they were possible.
How either of us walks away.
You may cancel anytime from Settings → Billing. We may suspend or terminate your account for material violations of these Terms with notice; serious violations (fraud, abuse, security breach) may terminate immediately.
On termination, your data is exportable for 30 days, then permanently deleted within 60 days. Backup tapes age out within an additional 30 days.
Where we settle disputes.
These Terms are governed by the laws of the Dubai International Financial Centre (DIFC), excluding its conflict-of-laws principles. Disputes are resolved by the DIFC Courts, sitting in Dubai.
If you’re a consumer in the EU, UK, or KSA, this section does not deprive you of any mandatory protections under your local law.
We notify before we change.
We may update these Terms. Material changes are announced 30 days in advance via email and in-product. Continued use after that period is acceptance of the new Terms; if you don’t accept, you may cancel.
